Explore Indonesia Ltd.

These Booking Conditions apply to the person making the booking and all other persons on whose behalf the booking is made. Please read these Booking Conditions carefully. They apply to all bookings made through Explore Indonesia Ltd., who are acting as agents on behalf of all of the suppliers (including airlines, tour and cruise operators, car hirers and accommodation providers) in your booking. You are contracting with the suppliers, whose terms and conditions apply to your booking. Copies of those terms and conditions are available upon request. These booking conditions govern your relationship with Explore Indonesia Ltd.. The person making the booking must be at least 18 years of age and must be authorised to make the booking on behalf of the members of the party. The person making the booking must also provide a copy of these booking conditions to the other members of the party.

The Contract and Booking Confirmation

A booking will be confirmed when the customer receives a written confirmation from Explore Indonesia Ltd. The customer will receive an invoice, the confirmation of their booking and a booking form by email. A confirmed reservation deposit is payable by customer, to guarantee the reservation. The deposit required is 30% of the total price of the dive trip booking. Additional hotel reservations and domestic flights are to be paid in full, in combination with (additional to) the confirmed reservation deposit. These payments are non-refundable. Our staff will do their utmost to help you if changes of bookings for hotels and domestic flights are needed. A fee might be applicable After we have received your deposit or full payment (if applicable) and we have issued a confirmation invoice, a contract will exist between you and each of the suppliers, effective from the date printed on your invoice. The terms and conditions of each supplier you have booked with will apply to your booking.

Agency

Explore Indonesia Ltd. acts as a travel agent. We arrange travel services and sell travel related products on behalf of suppliers such as airlines, cruise operators and accommodation providers. In doing so Explore Indonesia Ltd. gives no warranty nor makes any representation regarding the services to be supplied or the products purchased by you. Your booking will be subject to the terms and conditions applied by the provider of the service or products. You agree that if the travel services or products are not supplied in accordance with your booking your remedy lies with the service provider and not Explore Indonesia Ltd.

Payment

All payment instructions are sent to you by email when a payment is required. The payment can be made via:

1. PayPal (PayPal by Credit/Debit card Visa or MasterCard)
2. Bank transfer (details will be provided upon booking)

Please note that our PayPal payment facilities are denominated in Euros and should you choose to pay by this method the amount will be charged in Euros. We charge all extra cost on PayPal, please be aware that some banks do charge for transfer and this is not at the cost of Explore Indonesia Ltd. In every case, the sale contract is considered concluded only at the time of the debit of the account of the customer. All bank transfer charges are to be paid by the sender. It is the customer’s responsibility to arrange all the necessary authorizations for the purposes of use of the method of payment which they choose during the validation of their order.

Airline Taxes and Fuel Surcharges

All airfares are subject to taxes and charges levied by both government and the airlines themselves; in addition global fuel costs are constantly increasing. Airlines pass on the increase in taxes and fuel surcharges without notice and whilst we will endeavour to advise you of these charges in advance that may not always prove possible. Explore Indonesia Ltd. reserves the right to pass on fuel and tax increases, levied by airlines, without notice. Visitors to Indonesia are required to pay departure taxes at the airport (domestic and international).

Airline E-tickets

International and domestic airlines are replacing paper tickets with electronic tickets called e tickets. All passengers travelling on an e ticket will be required to present passport at check in.

Diving and Liveaboards

Customers must meet a minimum requirement for PADI Open Water Diver, CMAS 1* or equivalent to take part in diving activities (except if the travel package includes diving course). Customers recognize they must stop diving 18 hours before flying. The diving crew can refuse the diving practice of a participant if they don’t hold a certification of at least Open Water Diver PADI, CMAS 1* or equivalent. The customer when requested must show their certification card, log book, medical statement. Customers should respect the security rules given on the Liveaboards. The diving crew reserves the right to change the schedule or the choice of the dive sites according to the sea and weather conditions, or if the technical or physical level of the customers is not bespoke to the conditions. Customers will not hold Explore Indonesia Ltd. responsible for changes in schedule and number of dives made. No refund will be possible if customers don’t respect the security rules given by the tour leader or if customers don’t hold their certification card to show. Explore Indonesia Ltd. is not held responsible for diving accidents or other accidents which occurred during the diving trip. Customers recognize they should dive in their training limits and experience following the instructions given by the dive crew.

Cancellation Fees

If you cancel your booking you may incur a cancellation charge. The amount of this charge will vary depending on when the cancellation is made and the terms and conditions of the supplier of travel services or product. You can enquire at Explore Indonesia Ltd. about Cancellation Fees and Policy for specific supplier. If you are entitled to a refund please note Explore Indonesia Ltd. is unable to provide you with funds until they are received from the supplier.

Liability

As Explore Indonesia Ltd. is only acting as an agent we have no liability in respect of the supply of any element of your booking, including any liability for illness, personal injury, death or loss of any kind, delay and inconvenience caused directly or indirectly by any provider of travel services or products or by other third parties unless caused by our negligence. Any claim for damages for injury, illness, loss or death must be brought against the relevant supplier of the travel services or products.

Force Majeure

Explore Indonesia Ltd. shall not be liable for any loss or damage incurred by you as a consequence of Explore Indonesia Ltd. or any of the suppliers being unable to perform its obligations under your contract(s) due to the unusual or unforeseeable circumstances (a “force majeure event”) beyond the control of the party affected by the force majeure event.

Travel Insurance

Explore Indonesia Ltd. recommends that all customers purchase Travel Insurance policy with cover that includes cancellation, medical, personal liability and effects. Those who fail to do so will be responsible for their own losses. With World Nomads or Travel Guard you can get low cost holiday insurance that covers you for both your diving and travel needs. The customers understand they must provide their own travel insurance. Explore Indonesia Ltd. doesn’t provide any travel insurance.

Passport and Visas

It is your sole responsibility to ensure you have a valid passport at the time of travelling and that you hold all necessary visas and permits. Passport must be valid for a minimum of 6 (six) months as from the date of entry into Indonesia. Citizens from 52 countries and territories are eligible to apply for a Tourist Visa on Arrival. The maximum stay permitted by the visa on arrival is 30 days. There are no compulsory vaccinations.

Complaints

We hope you will have no reason to complain but if you are unhappy with any aspect of the services provided you must report it immediately to the supplier, or contact Explore Indonesia Ltd. We shall attempt to resolve the matter immediately but if you remain dissatisfied you must write to us within 28 days from the end of your trip or holiday. Failure to complain at your destination may mean we will be unable to resolve the dispute after you return home.

Governing Law

Your contract with Explore Indonesia Ltd. is governed by the laws of Hong Kong and you agree to submit to the jurisdiction of the courts of Hong Kong to determine any dispute pertaining to the contract.
